Terms of Service

1. Agreement to Terms

By accessing or using Terna's services ("Service"), including the website at terna.cc, the application at app.terna.cc, and the API at api.terna.cc, you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Service.

2. Definitions

  • "Terna" or "we": Refers to the AI-powered candidate screening platform operated at terna.cc
  • "User": Any person or entity that accesses or uses the Service
  • "Platform": The set of screening tools available at app.terna.cc
  • "Candidate data": CVs, personal information, and any candidate data processed through the Service
  • "AI results": Assessments, scores, and analyses generated by Terna's artificial intelligence system

3. Service Description

Terna is an AI-powered candidate screening platform designed for headhunters and recruitment professionals. The Service enables you to:

  • Upload and analyze candidate CVs
  • Generate automated assessments with traffic light scoring
  • Verify skills through cross-reference analysis
  • Create personalized interview guides
  • Share shortlists with clients

The Service is currently in beta phase. Features may change, be added, or be removed without prior notice.

4. Eligibility

To use the Service, you must:

  • Be at least 18 years of age
  • Represent a company or operate as an independent recruitment professional
  • Have the authority to accept these Terms on behalf of your organization, if applicable
  • Use the Service for legitimate recruitment purposes

5. Beta Terms

During the beta phase:

  • The Service is provided "as is" without guarantees of availability or performance
  • Features may change significantly between versions
  • The Service is free; pricing plans will be communicated before the transition to a stable release
  • We reserve the right to limit access or features at any time
  • We will notify you at least 30 days in advance before any transition to a paid model

6. Acceptable Use

You agree to use the Service only for:

  • Legitimate recruitment and talent selection purposes
  • Processing candidate data with the appropriate authorizations

You must not:

  • Reverse engineer, decompile, or disassemble any part of the Service
  • Use the Service to discriminate against candidates on legally protected grounds
  • Share access credentials with unauthorized third parties
  • Use the Service for purposes other than recruitment
  • Attempt to access other users' data
  • Intentionally overload the Service's infrastructure

7. Candidate Data Responsibilities

As a user of the Service:

  • You are the data controller for candidate data you process through Terna
  • You must have the necessary authorization to process candidate data
  • You are responsible for complying with applicable data protection legislation
  • You must inform candidates about the use of AI tools in the selection process, where required by law

Terna acts as a data processor and processes candidate data exclusively according to your instructions and for the provision of the Service.

8. AI-Generated Content

AI results provided by Terna:

  • Do not replace human judgment in hiring decisions
  • Are support tools to facilitate the screening process
  • May contain errors or inaccuracies
  • Should not be the sole criterion for accepting or rejecting candidates

Terna is not liable for hiring decisions based solely on AI results.

9. Intellectual Property

  • Platform: Terna owns all rights to the platform, including software, design, algorithms, and brand
  • User data: You retain all rights to data you upload or generate through the Service
  • AI results: Results generated by our AI for your data are your property

10. Service Availability

During the beta phase:

  • We do not guarantee a specific uptime percentage
  • Interruptions may occur due to maintenance or updates
  • We will endeavor to notify you of scheduled maintenance in advance

11. Limitation of Liability

To the maximum extent permitted by law:

  • The Service is provided "as is" and "as available"
  • We make no express or implied warranties about the Service
  • Our total liability for any claim shall not exceed the amount you have paid for the Service in the 12 months preceding the incident (or $0 during the free beta phase)
  • We shall not be liable for indirect, incidental, special, or consequential damages

12. Indemnification

You agree to indemnify and hold Terna harmless from any claims, damages, or expenses (including attorney fees) arising from:

  • Your use of the Service in violation of these Terms
  • Your failure to comply with data protection legislation
  • Third-party claims related to candidate data you process

13. Termination

  • Either party may terminate the relationship at any time
  • You may request deletion of your account and data by contacting legal@terna.cc
  • Terna may suspend or terminate your access if you violate these Terms
  • Upon termination, we will delete your data according to our Privacy Policy

14. Governing Law

These Terms are governed by the laws of the Republic of Chile. Any dispute shall be submitted to the jurisdiction of the competent courts of Santiago, Chile.

15. Changes to These Terms

We may modify these Terms periodically. We will post changes on this page with the update date. For material changes, we will notify you by email at least 15 days in advance. Continued use of the Service after changes are posted constitutes acceptance of the updated Terms.
